THESE TERMS AND CONDITIONS LIMIT THE LIABILITY OF VIYANTA AND VIYANTA.COM TO YOU AND CONTAIN A BINDING ARBITRATION PROVISION THAT GOVERNS ANY DISPUTES BETWEEN YOU AND VIYANTA AND VIYANTA.COM. BY ACCESSING VIYANTA.COM OR BY USING ANY OF VIYANTA’S SERVICES, YOU ARE AGREEING TO BE LEGALLY BOUND BY BOTH THE VIYANTA TERMS AND CONDITIONS AND THE VIYANTA.COM PRIVACY POLICY (COLLECTIVELY, THIS “AGREEMENT”). IF YOU DO NOT AGREE TO ANY PORTION OF THIS AGREEMENT, DO NOT ACCESS VIYANTA.COM AND DO NOT USE ANY OF VIYANTA’S SERVICES.
Viyanta.com is a platform that is owned and operated by Viyanta Appliance Service. In this Agreement, the words "Viyanta.com" and "We" and "Us" and "Our" include both Viyanta.com and Viyanta Appliance Service and their respective parents, subsidiaries, affiliates, agents, employees, successors and assigns. In this Agreement, the words "You" and "Your" include both individuals who, in any manner, access or use Viyanta.com and Viyanta's services, and any persons or entities represented by those individuals in a legal capacity. Viyanta.com and Viyanta's services may only be accessed or used by individuals who are at least 18 years of age and who can enter into legally binding contracts under applicable laws. If You are not at least 18 years of age or You cannot enter into legally binding contracts under applicable laws, do not access or use Viyanta.com and Viyanta’s services.
Viyanta.com is intended to be accessed and used for Your personal purposes only and not for any commercial or advertising purposes. You acknowledge and agree that You will access and use Viyanta.com accordingly. You also acknowledge and agree that You are prohibited from using any manual or automated methods, such as data mining, scraping, phishing or crawling, to send automated queries to, or to gather data or information from, Viyanta.com.
In order to schedule an appointment, You must first provide Us with certain personal and identifiable information, such as Your name, physical address, telephone number and e-mail address, along with information about Your service needs. Upon Our receipt of the information requested from You, and provided You have agreed to and accepted all terms and conditions of this Agreement, You may schedule an appointment with Viyanta.com (a “Scheduled Appointment”). You acknowledge and agree that all information provided to Viyanta.com and Viyanta by You will be complete, accurate and truthful. If We learn or suspects that any information provided by You is not complete, accurate and truthful, We have the right to discontinue any ongoing or future access or use of Our services by You. If You knowingly provide Us with any false, fraudulent or inaccurate information, You acknowledge and agree that You will be solely and fully liable to Us for any claims, damages, losses, costs, liabilities or penalties that result from or relate in any way to the provision of such false, fraudulent or inaccurate information by You, including attorneys’ fees.
The information provided by You will be held and used by Us. We may disclose your information to our service providers / service engineers to undertake the repair to your appliance and to provide us with relative technical information. We may also use your data for training and testing purposes. We may pass your data to any relevant regulator or dispute resolution provider. Your details may also be used by us to market and promote other complimentary products, services and solutions. We and the third parties (if applicable) may contact you by mail, telephone or email. If you no longer want your data to be used by third parties or by us for marketing purposes and you have not already notified us please contact us at our registered address. Our repair is backed with a limited 90 days service guarantee covering the part / portion of the machine / device / appliance repaired by Us.The limited repair guarantee is provided by Us and the original manufacturer / OEM / company is nowhere linked to this limited repair guarantee.
(1) ANY AND ALL PRE-EXISTING CONDITIONS THAT EXISTED PRIOR TO THE EFFECTIVE DATE OF THE LIMITED GUARANTEE, INCLUDING ANY REPAIR OR REPLACEMENT CAUSED BY DEFECTS EXISTING PRIOR TO THE SCHEDULED APPOINTMENT; (2) ANY AND ALL DAMAGE TO THE PRODUCT THAT IS NOT A DIRECT RESULT OF, OR SOLELY CAUSED BY, THE REPAIR SERVICES PROVIDED BY THE SERVICE PROVIDER DURING THE SCHEDULED APPOINTMENT, INCLUDING BUT NOT LIMITED TO ANY DAMAGE FROM ABUSE, MISUSE, INTRODUCTION OF FOREIGN OBJECTS INTO THE PRODUCT, THIRD PARTY ACTIONS SUCH AS VANDALISM, FIRE, AND ANY PRODUCT MODIFICATIONS OR ALTERATIONS MADE AFTER THE SCHEDULED APPOINTMENT; (3) ANY INCIDENTAL, CONSEQUENTIAL, OR SECONDARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS AWAITING REPAIR OR PARTS, LOSS OF BUSINESS OR PROFITS; (4) FAILURE TO FOLLOW THE MANUFACTURER’S INSTRUCTIONS; (5) CLAIMS THAT ARE NOT REPORTED WITHIN THIRTY (30) DAYS OF THE EXPIRATION OF THE TERM; (6) ANY FAILURES OR DEFECTS, PARTS AND/OR LABOR COSTS INCURRED AS A RESULT OF A MANUFACTURER’S RECALL; (7) DAMAGED PARTS RESULTING FROM FAILURE TO PROPERLY MAINTAIN THE PRODUCT; AND (8) ANY PRODUCTS WITH SAFETY FEATURE(S) REMOVED, DISABLED OR ALTERED.
We permit access to certain products, services, web-sites, advertisements, promotions, recommendations, advice, information and materials ("Third Party Content and Services") that are provided by advertisers, publishers, content partners, marketing agents, vendors and other third parties ("Third Party Providers").
You acknowledge that We do not investigate, monitor, represent or endorse the Third Party Content and Services available through Viyanta.com and other Viyanta’s services. Furthermore, Your access to and use of the Third Party Content and Services is at Your sole discretion and risk, and We shall have no liability to You arising out of or in connection with Your access to and use of the Third Party Content and Services. We hereby disclaim any representation, warranty or guaranty regarding the Third Party Content and Services, whether express, implied or statutory, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose, and any representation, warranty or guaranty of non-infringement or regarding the availability, quality, reliability, features, appropriates, accuracy, completeness, or legality of the Third Party Content and Services.
Furthermore, You acknowledge and agree that the Third Party Content and Services and any related third party terms of service are subject to change by the applicable third party at its sole discretion and without any notice.
